Arnold Roland Jaenisch, 70, of Clara City, has been charged with two counts of criminal vehicular homicide.
Jaenisch was issued a summons on Tuesday to appear in Chippewa County District Court on Aug. 20, at 1 p.m., to face charges stemming from a two-vehicle accident on Dec. 16, 2011, that killed Kelly Marie Berghorst, of Montevideo.
Berghorst was traveling north on Highway 29 when her 2001 Ford Escort was struck broadside by Jaenisch’s 1999 Chevrolet pickup, which was heading east on Chippewa County Road 13, six miles north of Montevideo.
Berghorst, 39, was pronounced dead at the scene, and Jaenisch was hospitalized with serious injuries. Both drivers were wearing their seatbelts.
Jaenisch’s vehicle allegedly drove through a double posted stop sign, failing to yield the right of way.
According to the complaint, Jaenisch’s blood alcohol was .11 within two hours of the accident.
Jaenisch is facing two felony counts of criminal vehicular homicide — the first for operating a motor vehicle in a negligent manner while under the influence of alcohol and the second for operating a motor vehicle while having an alcohol concentration of 0.08 or more.
Jaenisch is also facing misdemeanor charges for open bottle and stop sign violation.
