The Montevideo City Council acted on three nuisance abatement resolutions on Monday.

The Montevideo City Council acted on three nuisance abatement resolutions on Monday. The properties are located at 418 S. 7th St., 209 N. 9th St., and 1109 N. 17th St.

William B. McGraw and Shannon Larson, owners of the property at 418 S. 7th St., appeared before the council to explain their situation and state why they believe there is no nuisance.

The issue has been ongoing since the Aug. 7th, 2017 council meeting when the council passed Resolution No. 3454 which directed the abatement of a nuisance (the noise caused by a portable generator) by Sept. 5, 2017.

At the Sept. 5 council meeting, council members received input from the owners and staff, and action on the matter was tabled until the Sept. 18 meeting.

As of this past week’s council meeting, city staff reported that the nuisance had yet to be taken care of. As such, the council moved forward with the abatement resolution, which was adopted, and which authorizes the city to abate the nuisance by hiring all work necessary to accomplish the task.

All expenses incurred by the city are to be recovered from the property owners. If the property owners abate the nuisance themselves before the city does, the resolution will become null and void.
